JAK Schmidt, Inc. d/b/a Inside the Magic (“us”, “we”, or “our”) operates insidethemagic.net (the “Site”).   • For Legal Reasons: We may disclose your information if required to do so by law, regulation, or in response to valid legal processes or requests by public authorities (e.g., a court order, a subpoena, or a government request). 2. Prohibition on Artificial Intelligence Training and Scraping

The owner of this website does not consent to the content on this website being used or downloaded by any third parties for the purposes of developing, training or operating artificial intelligence or other machine learning systems (“Artificial Intelligence Purposes”), except as authorized by the owner in writing (including written electronic communication).

Absent such consent, users of this website, including any third parties accessing the website through automated systems, are prohibited from using any of the content on the website for Artificial Intelligence Purposes. Users or automated systems that fail to respect these choices will be considered to have breached JAK Schmidt, Inc. d/b/a Inside the Magic’s Terms of Service.

Inside the Magic operates as a platform for user discussion and does not actively pre-screen all User Content.

  • No Endorsement: User Content posted on the Site does not reflect the opinions, views, or policies of Inside the Magic. We do not endorse, guarantee the accuracy of, or assume any liability for any User Content posted by our users.
  • Right to Moderate: We reserve the absolute right (but assume no obligation) to monitor, review, edit, flag, or remove any User Content at our sole discretion, at any time, and for any reason, without notice to you. We may also suspend or terminate your access to the Site for violating these guidelines.

If you are the subject of such material posted on our Site, you or your authorized representative may submit a removal request by emailing dmca@insidethemagic.net with the subject line “Take It Down Request.” Please include a link to the specific material and a statement confirming you are the depicted individual. We will review and expeditiously remove qualifying content.

5. Disclaimers and Limitation of Liability

  • “As-Is” Provision: The Site and all content, services, and features are provided on an “AS IS” and “AS AVAILABLE” basis. Inside the Magic expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.   • Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Inside the Magic, its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site, including defamatory, offensive, or illegal conduct; or (iii) unauthorized access, use, or alteration of your transmissions or content.

6. Governing Law and Venue

These Terms of Service, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of New Mexico, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Site shall be instituted exclusively in the federal or state courts located in the State of New Mexico. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
